Ukraine lost a lawsuit with Lybid-1 satellite manufacturer

For a long time we have not heard anything about the project of the first national Ukrainian satellite Lybid-1, which was originally supposed to go to a position 48 degrees of east longitude and serve the territory of the country with broadcasting and high-speed Internet services. In fact, the spacecraft still not taking off is in storage in the Krasnoyarsk Territory of the Russian Federation. And Ukraine during all this lull time managed to sue Maxar Technologies, whose predecessor was engaged in the production of the Ukrainian telecommunications apparatus.
but, US business sources, court ended not in favor of the government of the Ukrainian state. 18-monthly discussion ended in UN arbitration court, who completely rejected the requirements of Ukraine and decided, that the legal costs and expenses of Maxar must be paid.
Agreement 2010 year provided for the construction of a telecommunications satellite by the Canadian company MacDonald, Dettwiler and Associates (MDA Corp.) - predecessor of Maxar Technologies. The contract value was estimated at 254 million US dollars.
The initial agreement with the MDA provided for the construction and launch of the satellite, as well as two control and monitoring centers and ground infrastructure. The satellite was supposed to provide Ukraine with television broadcasting and Internet access., as well as neighboring countries. MDA and the Ukrainian Space Agency had to fill out the necessary documentation and approve all the necessary technical parameters.
In 2014 MDA suspended work on the contract due to political instability in Ukraine, referring to force majeure. MDA was reporting at that time, what works with the client about further cooperation scenarios, to minimize negative consequences. At the same time, the company announced, that will suspend work for a period of 4 before 6 months, although the final cost, delay related, has not been installed.
In 2015 year reported, that the Lybid-1 program is now actually being implemented as a commercial project - at the expense of investment funds. Moreover, stated, that another satellite of the Ukrainian Lybid-2 group will be launched.
According to the publication of the Ukrainian edition of Mediasat, In 2017 a large sum of money was lost from project financing, and MDA completely left this project. According to available information, on the initiative of the Ukrainian side, the Seychelles intermediary company Briklin Limited was introduced into the agreement with MDA, which subsequently lost 8 millions of US dollars, destined to the enterprise "Pivdenmash". The latter was to build a "Zenit" launch vehicle for the satellite in orbit. Afterwards, Yuzhmash for some reason demanded this money from Russia.
In May 2019 years, Maxar CFO Biggs Porter announced his company's official position on this dispute as follows: "For those, who is not aware of [the situation], I would like to inform: we delivered a satellite to Ukraine, for the production of which we received cash. We delivered it to the place agreed by our parties. And then Russia attacked the Crimea and Ukraine lost access to this satellite.
Lybid-1 satellite was transferred by MDA to the Russian side in August 2014 year. Judging by the statement of Mr. Porter - with the permission of the Ukrainian side. In the meantime, the parties sorted out among themselves who and to whom should Lybid-1 be stored on the territory of the Reshetnev company in the Krasnoyarsk Territory of Russia.
As for the Lybid-2 satellite, to the 2015 no information was received on this project.
